Abstract

La Première Guerre mondiale confronte le droit public allemand à deux tendances et évolutions majeures, souvent contradictoires, mais qu’il convient de mettre en balance pour saisir toute la complexité de cette période charnière située entre deux siècles. D’une part, au regard du renforcement de l’État et de la concentration des pouvoirs qu’elle emporte, la guerre fait peser de nouvelles menaces sur l’État de droit allemand, dans ses traductions politiques comme économiques. D’autre part, au regard des évolutions et réflexions qu’elle suscite et nourrit, qu’il s’agisse de la parlementarisation du régime ou de l’enrichissement du droit administratif, la guerre est également porteuse d’impulsions fondamentales pour le renouvellement du droit public allemand. ABSTRACT : After the breakout of the First World War, the German public law has to face two major – and at times contradictory – developments, which both need to be considered to fathom the complexity of this pivotal period marking the close of one century and the dawn of a new one. On the one hand, the strengthening of the state and the concentration of power caused by the war effort pose threats of a new kind on the German constitutional state, both politically and economically. On the other hand, the developments and the reflective processes sparked or pushed on by the war – be it the parliamentarization of the German state or the expansion of administrative law – profoundly stimulate the reinvigoration of public law in Germany.
