Abstract

La structuration du marché européen de l'armement doit être considérée comme une étape supplémentaire et d'importance dans l'intégration européenne et l'achèvement du marché intérieur. Ce résultat est d'abord celui de la coopération intergouvernementale en matière d'armements qui a su se structurer de manière à ce que les éléments nécessaires à la construction d'un marché européen de l'armement intégré au marché intérieur soient réunis. L'armement est un secteur économique et stratégique qui fut exclu dès l'origine par le traité de Rome. L'ancien article 223 TCE (article 346 TFUE) comprenait une clause permettant aux Etats membres de soustraire l'armement au droit communautaire. Si la coopération européenne en matière d'armement débuta relativement tôt en dehors du cadre communautaire, ce n'est qu'avec la création de l'Union européenne et de la Politique de sécurité et de défense commune que les questions liées à l'armement ont pu être introduites dans le cadre juridique de l'Union européenne. La coopération menée dans le cadre de l'ancien deuxième pilier a établi les fondements pour la construction du marché européen de l'armement. Ce dernier est établi par l'application des règles du marché européen au secteur. Par ses arrêts la Cour de justice a accompagné la Commission dans sa volonté de faire appliquer les règles du marché européen à l'armement. Les raisons économiques et financières ont été des arguments forts pour une telle structuration. L'application de ces règles s'est d'abord faite de manière indirecte avant de parvenir à des directives applicables aux marchés publics de défense et aux transferts de produits de défense entre Etats membres.

The structuring of the European armament market should be considered as an additional and important step in European integration and the accomplishment of the internal market. This result is first of all that of the inter-governmental cooperation with regard to armament that has ensured that all the elements necessary for the construction of a European armament market integrated into the internal market were fulfilled. The armament sector is both economic and strategic and it was originally excluded from the Treaty of Rome. The former article 223 TEC (article 346 TFEU) included a clause that allowed the member States to exempt from European Community laws the subject. European cooperation with regard to armament started relatively early outside the community framework but it was only with the creation of the European Union and the common security and defence policy that questions linked to armament could be included within the legal framework of the European Union. The cooperation undertaken in the context of the former second pillar laid down the foundations for the construction of the European armament market. The latter is established through the application of the European market rules in the sector. Through its rulings the Court of Justice supported the Commission in its will to ensure that the rules on the European armament market were applied. Economic and financial reasons were strong arguments for this structuring. The application of these rules initially took place indirectly before the initiation of directives applicable to public defence markets and to transfer of defence products between member states.
