Abstract

L'évolution de l'intégration communautaire a mis en évidence des cas d'utilisation abusive ou frauduleuse du droit communautaire. Les particuliers invoquent les libertés de circulation pour échapper à une législation nationale et pour se faire appliquer une autre, plus favorable à leur intérêt. D'autre part, dans les domaines harmonisés, il s'agit de la tentation de bénéficier indûment des avantages tirés du droit communautaire par un accomplissement formel des conditions de son application. Confrontée à ce nouveau phénomène, la Cour de Justice des Communautés européennes a dû réagir et elle l'a fait par la recherche des plus adéquats moyens juridiques de lutte contre les comportements abusifs. D'un simple critère de détermination du champ d'application du droit communautaire, l'interdiction de l'abus de droit a été érigée au rang de raison impérieuse d'intérêt général. Finalement, dans la jurisprudence récente, l'acquisition du statut de principe général du droit communautaire ne peut plus être contestée. Création prétorienne, l'interdiction de l'abus de droit supposera toujours, tant de la part du juge communautaire que du juge national, un effort de réflexion sur la proportionnalité des droits exercés vis-à-vis des objectifs pour lesquels ils ont été octroyés et vis-à-vis des droits des tiers. L'interdiction de l'abus de droit permet d'assurer la cohérence du système juridique communautaire et de garantir un fonctionnement correct du marché intérieur.

The development of European integration has highlighted a diversity of cases of abusive or fraudulent use of EC law. Individuals invoke freedoms of circulation to avoid national legislation and to make possible the application of another one, more favourable to their interest. In addition, in the harmonized fields, there is the temptation to unduly profit from the advantages drawn from EC law by a formal fulfillment of the conditions prescribed by it. Confronted with this new phenomenon, the European Court of Justice had to react by researching the most adequate legal means to fight against abusive behaviors. Starting as a simple criterion to determinate the field of application of EC law, the prohibition of abuse of rights was set up as an imperative reason of general interest. Finally, according to recent case law, the acquisition of the statute of general principle is considered undisputable. The prohibition of abuse of rights will always imply, both for the European Court of Justice and for the national judge, the need to appreciate the proportionality of the rights exerted to the objectives for which they were granted and to the rights of third parties. The prohibition of abuse of rights makes it possible to ensure the coherence of the EC legal system and to guarantee a correct operation of the internal market.
