Abstract

Comment saisir l’insaisissable ? Si l’émergence d’un concept juridique est dictée par un besoin, c’est à la fonction du formalisme qu’il convient de s’intéresser. Seul le formalisme permet au droit de saisir le domaine des objets intellectuels, que nul n’est censé ignorer. Il s’adapte progressivement à chacun des titres, le brevet, la marque, le dessin ou modèle, y compris le droit d’auteur. Cette appropriation n’est qu’un état de fait ou de droit dans lequel la chose intellectuelle transite de manière éphémère. L’objet devient une res communis particulière qui devrait profiter à tous. Cette approche confronte un domaine approprié, vif et présent à un domaine inappropriable, obsolète, presque oublié : elle n’est pas celle dont est imprégnée cette étude. L’heure est à la responsabilisation. Rigoureusement formalisés, les éléments intellectuels peuvent être mis en commun. Dès lors que le formalisme délimite les contours du domaine intellectuel approprié, il peut aisément dessiner ceux du domaine intellectuel commun, au service de la propriété intellectuelle de demain.

If the emergence of a legal concept is dictated by necessity, it is the function of formalism that warrants close examination. Only formalism enables the law to apprehend the realm of intellectual objects, which no one is presumed to ignore. Formalism progressively adapts to each title—patents, trademarks, designs, and even copyright. Yet this appropriation constitutes merely a transient state, whether in fact or in law, in which the intellectual object momentarily resides. The object thus becomes a specific res communis that ought to benefit all. This approach juxtaposes a vibrant and tangible appropriated domain with an unappropriable, obsolete, and nearly forgotten domain. However, these reflections are not conducted within such a perspective. The focus here is on fostering accountability. Through rigorous formalization, intellectual elements can be pooled for the collective benefit. If formalism delineates the contours of the appropriated intellectual domain, it can equally trace the boundaries of a shared intellectual domain, paving the way for the intellectual property of tomorrow.
