Abstract

Les minorités religieuses, linguistiques, ethniques et nationales aspirent à former des États indépendants, ce qui engendre des aspirations séparatistes susceptibles de mettre en péril l'unité des États où ils résident. Avec les évolutions politiques, démographiques et potentiellement géographiques au Proche-Orient, les minorités se sont trouvées au sein des conflits, voire à leur origine. Il est donc nécessaire de se poser la question de savoir s'il convient d’encourager les velléités indépendantistes ou au contraire, de les réprimer au profit de l'État. Dans ce contexte, quelles solutions alternatives pourraient être envisagées pour protéger ces minorités et garantir leur intégration dans leurs États ? La thèse défend l'intégration des minorités au sein d'un État face au risque potentiel d’application du droit à l’autodétermination. Elle se penche d’abord sur les modalités de transposition aux minorités de ce droit à l’autodétermination et étudie son applicabilité avant de mettre en lumière ses risques. Afin d’éviter les risques liés à la succession d’Etats la thèse explore les moyens de préserver l'intégrité et l'unité de l'Etat. Ces moyens se reflètent à travers l’octroi aux minorités de droits au sein de l'Etat ainsi que l'établissement d'une structure étatique adaptée à la protection des minorités en mettant l’accent sur un fédéralisme atypique associé à un système gouvernemental consociatif.

Religious, linguistic, ethnic, and national minorities aspire to form independent states, which gives rise to separatist aspirations that can endanger the unity of the states in which they reside. With political, demographic, and potentially geographical changes in the Near East, minorities have found themselves embroiled in conflicts, and are sometimes at their source. It is therefore necessary to consider whether to encourage independence aspirations or, conversely, to suppress them in favor of the state. In this context, what are the alternative solutions that could be envisaged to protect these minorities and ensure their integration into their states ?The thesis argues for the integration of minorities within a state in the face of the potential risk of applying the right to self-determination. It first examines the modalities of transposing this right to minorities and studies its applicability before highlighting its risks.To avoid the risks associated with state succession, the thesis explores means to preserve the integrity and unity of the state. These means are reflected in granting minorities rights within the state and establishing a state structure adapted to the protection of minorities, emphasizing an unconventional federalism associated with a consociational governmental system.
