Abstract

Le constat d’une crise environnementale à l’échelle internationale invitait à une réaction de la sphère juridique. Le droit a alors déployé sa fonction protectrice à l’égard de l’environnement. Si la protection de l’environnement apparaît comme le fruit de la coopération initiale entre acteurs étatiques, au regard de l’implication des acteurs privés et du caractère souvent transfrontière des atteintes à l’environnement, l’étude de la protection de l’environnement en droit international privé devait être envisagée. L’objectif de cette étude est, par conséquent, de démontrer que l’intervention du droit international privé en matière de protection de l’environnement est certes adaptée mais doit être améliorée. Visant cette amélioration, il convient d’observer l’intégration de l’impératif environnemental au sein des règles de compétence judiciaire internationale et de compétence législative aux fins de renforcer la justice environnementale, tant dans ses aspects substantiels que procéduraux.

The observation of an environmental crisis on an international scale called for a reaction from the legal sphere. The law then deployed its protective function to the environment. While environmental protection appeared to be the result of an initial cooperation between state actors, acknowledging the cross-border nature of environmental damage and the involvement of private actors, the study of environmental protection under the prism of private international law had to be considered. Therefore, the objective of this thesis is to demonstrate that the intervention of private international law in the field of environmental protection is appropriate but must be improved. Aiming for this improvement, it should be observed the integration of environmental concerns within the rules of conflict of jurisdictions and conflict of laws to strengthen environmental justice, both in its substantive and procedural aspects.
