Abstract

Les progrès des nouvelles technologies s'attachent de plus en plus à l'humain et leurs perspectives sont vastes. L'humain se distingue essentiellement à travers la summa divisio qui oppose les personnes et les choses. Or, d'un point de vue strictement littéral, lui rattacher le terme de « transformation » est lourd de sous-entendus et ne semble pas de prime abord évoquer la science juridique. En réalité, l'étude des perspectives de droit privé de l'humain en transformation consiste à s'interroger sur les différents facteurs de transformation de l'être humain, et les conséquences produites en droit privé. Ainsi, la démonstration retenue va s'attacher aux transformations qui naissent au moment de la relation de soins, en distinguant la finalité thérapeutique ou non de cette relation. Ces transformations vont trouver leur origine dans la recherche médicale qui vient bouleverser la distinction entre les personnes et les choses. L'analyse consistera ensuite à envisager progressivement les étapes se situant après la mise en œuvre de cette recherche. Elle s'achèvera sur l'étude de l'humain augmenté.

The progress of the new technologies is becoming more and more attached to the human being and their perspectives are vast. The human is essentially distinguished by the summa divisio between persons and things. However, from a strictly literal point of view, attaching the term 'transformation' to it is full of subtleties and does not seem at first sight to evoke legal science. In reality, the study of the private law perspectives of the human being in transformation consists in questioning the different factors of transformation of the human being, and the consequences produced in private law. Thus, the demonstration selected will focus on the transformations that arise at the time of the care relationship, distinguishing between the therapeutic or non-therapeutic purpose of this relationship. These transformations will find their origin in medical research, which changes the distinction between persons and things. The analysis will then progressively consider the stages following the implementation of this research.
