Abstract

La valorisation et l’innovation sont deux notions relativement peu explorées par le droit. Issues de la science économique elles représentent respectivement l’action d’accorder de la valeur à une entreprise au regard des informations comptables et de son potentiel de développement et l’intégration d’une invention dans l’économie provoquant la croissance. En somme, la valorisation de l’innovation est l’action d’accorder une valeur à la diffusion des inventions techniques dans le marché. Appliquée au domaine de la santé, il ressort une urgence de développer et favoriser l’intégration d’inventions au sein de la société. Toutefois il est également facile d’entrevoir les dangers d’une innovation dérégulée, qui ne peut être qualifiée de progrès.À cet égard, il apparait que la science juridique doit être la clef de voûte de l’innovation ; le droit ne doit pas être au service unique de l’économie, ou de la recherche scientifique, mais une composante structurant le développement et la diffusion de l’innovation. En ce sens, la présente thèse démontre que la création d’un droit de l’innovation, à la fois souple pour permettre son développement, par nature imprévisible, et à la fois structurant permettrait de favoriser, structurer et valoriser l’innovation en santé. Ainsi, dans un premier temps il est question de démontrer qu’un droit prospectif de l’innovation est à envisager au regard des structures de recherche, et des régulations encadrant l’accès aux ressources biologiques et humaines (Partie I). Puis, dans un second temps que l’avènement d’une telle régulation permettrait une meilleure articulation avec le droit de la propriété intellectuelle et de la concurrence, vecteurs de valorisation et de diffusion des inventions (Partie II).

Valorisation and innovation are two concepts that are not well known in law. Originating from economics, they represent respectively the action of giving value to a company in terms of accounting information and its development potential, and the integration of an invention into the economy causing growth. In sum, valuing innovation is the act of placing a value on the diffusion of technical inventions in the market. Applied to the field of health, it is easy to understand the urgency of developing and fostering the integration of inventions within society, but it is also easy to see the dangers of deregulated innovation.In this respect, it appears that legal science must be the keystone of innovation; the law must no longer be at the service of the economy or to the detriment of scientific research, but a component structuring the development and diffusion of innovation. In this sense, this thesis demonstrates that the creation of a law of innovation, which is both flexible to allow its development, which is by nature unpredictable, and at the same time structuring, would make it possible to promote, structure and enhance innovation in health. Thus, firstly, it is necessary to demonstrate that a prospective law of innovation should be envisaged regarding research structures and the regulations governing access to biological and human resources (Part I). Then, in a second step, it is shown that the advent of such a regulation would allow for a better articulation with intellectual property and competition law, vectors of valorisation and diffusion of inventions (Part II).
