Abstract

L'influence constitue un procédé prégnant dans la société. Que celle-ci soit bienveillante ou non, intentionnelle ou non, les conséquences qu'elle induit peuvent avoir des répercussions sur le comportement d'un être en construction : le mineur. A ce titre, dès lors que ces comportements peuvent avoir une corrélation avec le droit pénal, ce dernier doit pouvoir prendre en considération ces agissements en tenant compte d'un élément intentionnel qui aurait pu être corrompu par une influence néfaste à l'expression même de la volonté du mineur et ce, qu'il soit auteur ou victime d'une infraction. Ne bénéficiant d'aucune assise en droit pénal, l'influence ne peut, pour autant, pas être qualifiée de "notion". En effet, sans définition propre, sans débat l'entourant et plus largement la consacrant, l'influence doit trouver sa place dans le vocable juridique et judiciaire par le biais d'une politique criminelle davantage tournée vers l'aspect cérébral des agents mis en confrontation.

Influence is a significant process in society. Whether it is benevolent or not, intentional or not, the consequences it induces can have repercussions on an evolving human's behavior: the miner. As such, since these behaviors can have a correlation with criminal law, the latter must be able to take into account these acts by taking into account an intentional element which could have been corrupted by a detrimental influence on the very expression of willingness whether he is the perpetrator or the victim of an offense. Having no basis in criminal law, influence cannot, however, be qualified as a "concept". Indeed, without proper definition, without debate surrounding it and more broadly devoting it, influence must find its place in the legal and judicial term through a criminal policy more oriented towards the cerebral aspect of the agents put in confrontation.
