Le champ d'application de la règle consumériste.

Abstract
La règle consumériste n’a pas une portée générale. Elle s’applique en principe à un professionnel et un consommateur et ne régit pas toutes les situations où ils sont impliqués. Celles-ci doivent correspondre à l’objet spécifique de la règle. Le législateur adopte une démarche originale en établissant une corrélation entre les sujets et l’objet de la règle consumériste. L’étude est alors conduite en conjuguant la qualification des sujets de la règle et l'utilisation de son objet. Ce n’est pas leur juxtaposition mais la compréhension de leur influence réciproque qui fait l’originalité de la démarche et permet de dégager des enseignements techniques et fondamentaux. La première partie de la thèse révèle la méthode utilisée par le législateur et le juge pour qualifier les sujets de la règle consumériste et permet d’en souligner les faiblesses. La seconde partie complète l’analyse du champ d'application de la règle consumériste, en distinguant la règlementation du rapport de consommation et celle du phénomène de consommation. La conclusion générale du travail propose d'unifier la qualification des sujets de la règle et son objet, en s'appuyant sur ses objectifs et son fondement juridique. L'étude du champ d’application de la règle consumériste démontre que celle-ci ne peut poursuivre efficacement qu'un objectif économique et repose principalement sur le fonctionnement du marché intérieur. Des propositions sont effectuées en conséquence afin de présenter les limites et les perspectives du champ d'application de la règle consumériste.
,The consumer rule does not possess a general scope of application. In principle, the rule applies between a professional and a consumer. It does not govern all interactions between such parties, only those falling within the specific material scope The legislator adopts an original approach by correlating the identity of the subjects and the material scope of the rule. This study combines the qualification of the rule's subjects with the use of its object. What makes this approach distinctive is not the mere juxtaposition of subject and object, but rather the understanding of their reciprocal influence, which allows both technical and fundamental insights. The first part of the thesis reveals the method used by legislators and judges to qualify the subjects of the consumer rule and highlights its limitations. The second part complements the study of the rule’s scope of application by distinguishing the regulation of the consumer relationship and the broader phenomenon of consumption. The general conclusion proposes to unify the qualification of the rule's subjects and its object by leveraging its purpose and legal foundations. The analysis of the rule’s scope has notably demonstrated that it can only effectively pursue an economic objective and is primarily based on the internal market operation. Consequently, proposals are made to outline both the limits and the future prospects of the consumerist rule’s scope of application.
