Abstract

Les libertés de réunion, pensées au XIXe à la fois comme des libertés individuelles d'exercice collectif et un mécanisme de garantie des droits, se sont construites dans leur dimension relationnelle, en opposition aux gouvernants. La présente étude propose d'identifier et d'expliquer la dynamique contemporaine des rapports entre les libertés de réunion et la démocratie. En effet, celle-ci implique tout à la fois des solutions destinées à faire des libertés de réunion des droits « concrets et effectifs » et d'autres qui font figure de restrictions à leur exercice. Ce faisant, les régimes espagnol, français et marocain permettent d'éclairer les subtilités de la théorie des libertés de réunion dans un contexte démocratique variable. Partir du Maroc – terrain d'observation et de réflexion particulièrement intéressant eu égard à son statut d'État en transition juridictionnelle et démocratique – permet ensuite d'étendre l'étude à l'Espagne et à la France. Cet élargissement est notamment justifié par des considérations socio-historiques, théoriques et substantielles. La comparaison repose d'une part sur une identification conceptuelle et axiologique des libertés de réunion et d'autre part sur l'étude de leur conciliation juridictionnelle avec les intérêts protégés dans une société démocratique. L'étude met en évidence une nouvelle tendance au sein du couple « libertés de réunion et État démocratique » : celle d'une relation moins construite sur la garantie de la sécurité publique que sur la lutte contre l'arbitraire. Le caractère de droit civil des libertés de réunion se voit ainsi renforcé au détriment de leur nature politique.

Freedom of Assembly, originally conceived in the 19th century as individual freedoms exercised collectively and as a mechanism for safeguarding rights, has been shaped through its relational dimension in opposition to power. This study aims to identify and explain the contemporary dynamics between freedom of assembly and democracy. Indeed, democracy simultaneously entails measures intended to make freedom of assembly "concrete and effective" as well as others that act as restrictions on its exercise. In this regard, the Spanish, French, and Moroccan legal systems help shed light on the subtleties of the theory of freedom of assembly within varying democratic contexts. The analysis begins with Morocco—a particularly compelling case due to its status as a state undergoing judicial and democratic transition—and then broadens to include Spain and France. This comparative approach is driven by historical, theoretical, and substantive factors. The comparison is based on the one hand, on a conceptual and axiological identification of the freedoms of assembly, and on the other, on the judicial reconciliation of these freedoms with the interests protected in a democratic society. The study highlights a new trend in the relationship between “freedom of assembly and the democratic state”: a shift from a framework primarily concerned with public security to one focused more on the fight against arbitrariness. As a result, the civil rights character of freedom of assembly is increasingly emphasized at the expense of its political nature.
