Abstract

Alors que se déploie à l’international un troisième front de la justice climatique – celui du climate-washing des entreprises, aux côtés des contentieux d’inaction climatique et de responsabilité pour les émissions passées – , cette contribution analyse la première condamnation judiciaire française visant les allégations d’engagement d’une carbon major. À partir de l’affaire TotalEnergies, elle retrace la « fabrique » du procès, depuis la construction experte de l’assignation associative jusqu’à sa réception par le juge. L’étude met en lumière la manière dont le droit de la consommation, irrigué par les référentiels scientifiques internationaux du climat, est mobilisé comme instrument indirect de redevabilité climatique des entreprises. Tout en étant marqué par une grande prudence structurelle, le jugement consacre une avancée majeure dans la qualification du climate-washing commercial et dans l’écologisation du standard du consommateur au service de la transition. Au-delà du litige, cette décision illustre l’évolution du droit de la consommation – de la protection individuelle à la régulation d’un nouveau modèle économique – et ouvre la voie à une véritable compliance commerciale climatique exigible sur le marché.

At a time when a third front of climate justice is emerging internationally–that of corporate climate-washing, alongside climate inaction litigation and liability claims relating to past emissions–this contribution analyses the first French judicial ruling targeting the climate commitment claims of a carbon major. Drawing on the TotalEnergies case, it traces the “making” of the litigation, from the expert construction of the NGOs’ claim to its reception by the court. The study highlights how consumer law, informed by international climate science frameworks, is mobilised as an indirect instrument of corporate climate accountability. While characterised by considerable structural caution, the judgment nevertheless constitutes a major step forward in the legal qualification of commercial climate-washing and in the ecologisation of the consumer standard in support of the ecological transition. Beyond the dispute itself, this decision illustrates the evolution of consumer law–from individual protection to the regulation of a new economic model–and paves the way for genuine climate-related commercial compliance enforceable on the market.
