Abstract

En Afrique noire francophone, les élections constituent le premier facteur conflictogène. Ainsi, la juridictionnalisation des élections nationales s’inscrit dans une dynamique de pacification du processus de dévolution des pouvoirs politiques suprêmes. A cet effet, les règles d’organisation et de fonctionnement de cette juridictionnalisation incarnée par les Cours et Conseils constitutionnels, variables d’un Etat à un autre, visent à garantir la régularité et la sincérité des scrutins présidentiels et législatifs. Toutefois, cette juridictionnalisation est hypothéquée par sa politisation marquée par le caractère présidentialiste de la nomination du juge. Ainsi, au Bénin et au Sénégal, le juge constitutionnel joue un rôle variable à la pacification et à la stabilisation du processus de dévolution du pouvoir matérialisées par des alternances démocratiques. En revanche, en Côte d’Ivoire, la politisation flagrante du juge constitutionnel provoquera une alternance armée au lieu d’entériner l’alternance démocratique propulsée par les électeurs. D’où la nécessité de procéder à des réformes de la juridictionnalisation afin de garantir au juge l’indépendance et la place qui répondent aux enjeux de la consolidation de la démocratie électorale en Afrique noire francophone.

In French-speaking black Africa, elections are the primary factor causing conflicts.Jurisdictionalisation of presidential and legislative elections is part of the strategies with the ambition to pacify the process of devolution of supreme political powers. The rules of organization and functioning of this jurisdictionalisation, embodied by the Constitutional Courts and Councils and varying from one country to another, aim to guarantee regularity and sincerity of the presidential and legislative elections. However, this jurisdictionalisation is hypothecated by its politicization marked by the presidentialistic character of the appointment of the judge. In Benin and Senegal, the constitutional judge plays a variable role in pacifying and stabilizing the process of devolution of power realized through democratic alternations. In the other hand, in Ivory Coast the flagrant politicization of the constitutional judge will cause an alternation of armed forces instead of endorsing the democratic alternation driven forward by the electors. Hence the necessity to carry out reforms of the jurisdictionalisation in order to guarantee the independence and place of the judge, needed to respond to the challenges of the consolidation of electoral democracy in French-speaking black Africa.
