Abstract

L’office du juge constitutionnel cristallise les conflits entre les ordres juridiques communautaire et nationaux. Cette étude entend mesurer l’incidence du droit communautaire sur les ordres juridiques français et italien devant leurs juges constitutionnels respectifs. Ce processus est apprécié selon une double approche. En tant que juge de la loi, le juge constitutionnel est susceptible d’intégrer le droit communautaire comme paramètre de référence dans son contrôle de constitutionnalité des lois. Parce qu’il est gardien du respect de la Constitution, il peut également opposer les normes constitutionnelles au droit communautaire lorsque ce dernier constitue l’objet de son contrôle. En conséquence, il s’agit d’envisager la pénétration du droit communautaire au sein du contentieux de constitutionnalité des lois (droit communautaire comme paramètre de référence) et ses limites (droit communautaire comme objet du contrôle). Sur le premier point, l’angle d’approche retenu part du principe de l’existence au niveau communautaire d’une obligation, à la charge du juge constitutionnel, de veiller au respect du droit communautaire pour en mesurer la « réception » par celui-ci. Sur le second, le contrôle de constitutionnalité du droit communautaire ne sera pas appréhendé comme un verrou, mais comme un moyen, nécessaire, destiné à accompagner les profondes modifications de l’ordre juridique interne impliquées par l’appartenance à l’Union et à la Communauté européennes. C’est à partir d’une étude de droit comparé franco-italienne que l’analyse sera conduite, sans pour autant oublier les contraintes qui résultent du droit communautaire lui-même.
Summary
The functions of constitutional court crystallizes the conflicts between national and community systems. The present study seeks to assess the incidence of Community Law on French and Italian systems before their respective constitutional courts. This process is evaluated according to a double approach. As a judge of acts of Parliament, the constitutional court may integrate community law as a reference parameter when reviewing the constitutionality of acts. Because it ensures that the Constitution is respected, it may also oppose constitutional norms to Community Law when the latter constitutes the object of its control. As a consequence, we shall consider the penetration of Community Law within the judicial review of legislative acts (Community Law as a reference parameter) and its limits (Community Law as the object of control). In the first point, the approach chosen starts from the assumption that constitutional court is bound to ensure that Community Law is respected in order to assess its reception. In the second point, the review of constitutionality of Community Law shall not to be apprehended as an impediment, but as a necessary means, intended to accompany the profound modifications of the internal system implied by the membership of the Union and European Community. This analysis is based on a French-Italian comparative study, while taking into account the constraints which result from Community Law itself.
