abstract: S’inscrivant dans un prolongement consumériste de ces moyens de défense au fond, l’arrêt de la Cour de cassation du 8 avril 2021 conforte la jurisprudence antérieure sur la délicate question de la prescription en matière de disproportion manifeste entre l’engagement et les biens et revenus, invoquée par la caution. Le défendeur ne saurait être contraint par le calendrier du demandeur, qui pourrait choisir stratégiquement de se parer de la prescription
pour dissimuler son propre manquement à l’exigence de proportionnalité.
