abstract: La loi permettant d’apprécier l’incapacité de recevoir un legs est celle en vigueur au jour de l’établissement du testament, non du décès. L’auxiliaire de vie à domicile n’était donc pas, en 2016, dans l’incapacité de recevoir le legs stipulé dans un testament en 2013.
