abstract: La Cour de cassation énonce pour la première fois que le conjoint survivant est tenu à un « rapport spécial en moins prenant » des libéralités reçues par lui par le défunt. Cette affirmation, qui n’était pas nécessaire pour justifier le rejet des pourvois, pose la question de la nature réelle de l’imputation des libéralités conjugales sur les droits légaux du conjoint.
